Reviews and public submissions

We may review, moderate, edit for formatting, reject, remove, or restrict reviews or other content that violates our Terms of Use, Review Guidelines, or applicable law.
We may retain internal records related to submitted reviews, including moderation decisions, abuse reports, and related account activity, for security, compliance, dispute resolution, quality control, and enforcement purposes.
Marketing emails
We use email marketing and customer relationship tools, including Mailchimp and HubSpot, to manage opt-in email communications. We only send marketing emails where permitted by law and where you have opted in or otherwise provided permission. You may unsubscribe or update your preferences using the link included in our emails or by contacting us.
HubSpot’s own DPA states that customers are responsible for providing appropriate notices, obtaining necessary consents, honoring opt-outs, and complying with email marketing laws when using HubSpot services. Mailchimp also provides a Data Processing Addendum covering its role as a service provider/processor for customer data.
Cookies and analytics
We use cookies and similar technologies to operate our Services, remember preferences, support account login features, analyze usage, improve performance, and understand how visitors interact with our content.
We use Google Analytics and Google Tag Manager to collect and analyze usage data. Google Analytics may use cookies, device identifiers, and usage data to measure site interaction. We do not intentionally send names, email addresses, or other directly identifying information to Google Analytics.

The European Commission lists GDPR rights including the rights to be informed, access, rectification, erasure, restriction, portability, objection, and rights related to automated decision-making. California’s CCPA gives covered California consumers rights including knowing, deleting, opting out of sale or sharing, correcting inaccurate information, limiting sensitive personal information use, and non-discrimination. Virginia’s VCDPA applies only above certain thresholds and includes rights to access, correct, delete, port data, and opt out of targeted advertising, sale, or certain profiling.

These Terms of Use govern your access to and use of The Agile Brand, LLC websites, applications, databases, tools, newsletters, review features, and related services, including The Agile Brand Guide®, The Agile Brand Guide List, Agile Brand Guide Research, Stackalize, Feedalize, Measurize, Advertalize, and related properties.
By accessing or using the Services, creating an account, submitting a review, or posting content, you agree to these Terms. If you do not agree, do not use the Services.
Accounts
Some features may require an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly if you believe your account has been accessed without authorization.
We may refuse registration, suspend access, restrict functionality, or terminate accounts as described in these Terms.
User reviews and user-generated content
The Services may allow users to submit reviews, ratings, comments, feedback, descriptions, profile information, and other content.

License to user content
You retain ownership of content you submit. By submitting content to the Services, you grant The Agile Brand, LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, modify for formatting or clarity, create derivative works from, and otherwise use the content in connection with operating, promoting, improving, and providing the Services.
This license continues even if you stop using the Services, subject to applicable law and our Privacy Policy.
Review integrity
You may not submit, request, purchase, sell, incentivize, manipulate, or coordinate fake, misleading, deceptive, or biased reviews.
You may not submit a review if:
- You have not had a genuine experience with the product, company, service, or subject being reviewed.
- You are posting on behalf of someone else without authorization.
- You are an employee, contractor, investor, advisor, competitor, or otherwise materially connected to the subject of the review, unless you clearly disclose that relationship.
- You were paid, rewarded, pressured, or offered something of value for submitting a positive or negative review, unless this is clearly disclosed and permitted by law.
- You are using multiple accounts, aliases, bots, automation, or coordinated activity to influence ratings or rankings.
We may investigate suspected review manipulation and may remove content, adjust ratings, restrict accounts, or take other action when we believe review integrity has been compromised.
Prohibited content
You may not submit, post, upload, transmit, or otherwise make available content that:
- Contains profanity, vulgarity, or obscene material
- Is harassing, threatening, abusive, hateful, discriminatory, or defamatory
- Attacks individuals based on race, ethnicity, religion, gender, sexual orientation, disability, nationality, age, veteran status, or other protected characteristics
- Contains sexually explicit, violent, or graphic material
- Promotes illegal activity
- Contains spam, advertising, promotional content, affiliate links, or unrelated solicitations
- Contains malware, scripts, tracking code, or harmful files
- Includes confidential, proprietary, private, or sensitive information
- Includes another person’s personal information without permission
- Infringes intellectual property, publicity, privacy, or other rights
- Is false, misleading, fraudulent, or deceptive
- Is irrelevant to the product, company, service, or topic being reviewed
- Attempts to manipulate rankings, ratings, recommendations, or search visibility
- Violates these Terms, our Review Guidelines, or applicable law
Moderation and removal
We may, but are not obligated to, review, screen, edit, refuse, remove, restrict, reclassify, or disable access to any content at any time.
Reasons for moderation may include, but are not limited to:
- Profanity or inappropriate language
- Harassment, abuse, or personal attacks
- Hate speech or discriminatory content
- Spam or promotional content
- Fake, deceptive, or manipulated reviews
- Conflicts of interest or undisclosed relationships
- Irrelevant or low-quality content
- Confidential or personal information
- Legal concerns
- Security concerns
- Violation of these Terms or our Review Guidelines
We may also remove or restrict content when we believe doing so is necessary to protect users, third parties, our Services, our business, or the integrity of our review and ranking systems.
We are not required to publish any user content and do not guarantee that submitted content will remain available.
Account suspension and termination
We may suspend, restrict, disable, or terminate your account or access to any part of the Services at any time, with or without notice, for any reason or no reason, to the maximum extent permitted by law.
Reasons may include, but are not limited to:

- Posting profanity or inappropriate content

- Conduct we determine to be harmful to the Services, our business, or our community
Termination may result in deletion, restriction, or continued retention of content or account information, subject to our Privacy Policy and applicable law.
Nothing in these Terms limits our ability to cooperate with law enforcement, comply with legal obligations, protect our rights, or take action to maintain the integrity and safety of the Services.
No obligation to monitor
We do not assume responsibility for monitoring all user content. User content reflects the views of the user who submitted it, not The Agile Brand, LLC. We do not endorse, verify, or guarantee the accuracy, completeness, reliability, or usefulness of user content.
Platform listings, rankings, and information
The Agile Brand Guide List may include profiles, ratings, rankings, descriptions, analysis, or other information about marketing technology, advertising technology, AI, customer experience, and related platforms.
We may update, modify, add, remove, rank, categorize, or reclassify listings at our discretion. We do not guarantee that any listing, ranking, rating, description, or analysis is complete, accurate, current, or suitable for any specific purpose.
The Services are provided for informational purposes only and should not be treated as legal, financial, procurement, technical, or professional advice.
Intellectual property
The Services, including our trademarks, logos, designs, text, graphics, data, software, rankings, reports, research, and other materials, are owned by The Agile Brand, LLC or its licensors and are protected by intellectual property laws.

To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services or these Terms will not exceed the greater of $100 or the amount you paid us, if any, for the Services giving rise to the claim during the twelve months before the claim arose.
Indemnification
You agree to defend, indemnify, and hold harmless The Agile Brand, LLC and its owners, officers, employees, contractors, affiliates, partners, and licensors from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of the Services
- Your content
- Your violation of these Terms
- Your violation of applicable law
- Your violation of another person’s rights
- Your review activity, including fake, misleading, infringing, defamatory, or unlawful reviews
Changes to these Terms

Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Venue for disputes will be in the state or federal courts located in Virginia, unless applicable law requires otherwise.
