Yesterday’s Marketing Technology & AI News: October 17, 2026

Which step in your funnel should an AI agent take, and which step should a person keep? On October 16, 2026, Smith.ai, the legal front-office company that pairs AI with more than 500 live agents, reported from more than 3.2 million law firm calls that qualified callers booked a next step 59% of the time with human-only handling, 52% with hybrid AI and human handling, and 33% with AI alone. The same day, Huble Digital Group, Auros, Treasure AI, MediaClaw, Kling AI, Reshift Media and MMGY Global with R&R partners released research, products and a merger that push AI further into marketing budgets, creative production and customer contact.

Marketing budgets are moving first. Huble Digital Group, a HubSpot Elite Solutions Partner, surveyed 393 HubSpot customers at HubSpot UNBOUND 2026 in Boston in September 2026 and found that 70% plan to increase AI spending over the next 12 months, 34% already use at least one HubSpot AI agent, and 61% use two or more AI tools every day. Huble’s respondents named Claude (64%), ChatGPT (63%) and Copilot (41%) as third-party tools in use, which means one marketing team runs tools from several vendors against the same first-party data. Huble CEO Rebecca Harris tied AI results to CRM data quality. If your CRM or customer data platform (CDP) holds duplicate contacts, every one of those tools inherits the duplicates.

Shoppers set the limit on AI in advertising. Auros, the company behind UserTesting and User Interviews, commissioned Talker Research to survey 4,000 adults in the U.S., U.K. and Australia from August 26 to September 1, 2026. In the Auros U.S. sample, 43% said they had felt duped by a product advertised with AI, 53% said they do not trust AI-advertised products to be described accurately, and 44% said they go out of their way to buy from brands that do not use AI in their ads. Only 20% of the Auros U.S. respondents correctly identified real products that had been enhanced with AI. The same U.S. respondents use AI as a shopping tool: 53% said AI has helped them shop, and 54% plan to use it for some holiday shopping.

Put plainly, shoppers in the Auros study cannot reliably spot AI in an ad, and they penalize the brand when they believe they have.

Kling AI, the AI-powered creative platform, launched Kling 4.0 on October 16, 2026, a video generation model that produces 30 seconds of video in one pass from up to 15 reference assets and 10 keyframes, with agent access through Kling MCP and availability in Adobe Firefly announced as coming soon. A brand team can draft a 30-second spot in one generation, and 44% of U.S. adults in the Auros study say they avoid brands that use AI in their ads. The disclosure rule for AI-made creative belongs with the Chief Marketing Officer (CMO) and legal, and it needs to exist before the creative team scales production.

Vendors also gave their agents job descriptions on October 16, 2026. Treasure AI, the agentic experience platform formerly named Treasure Data, announced Digital Worker at its Agentic World 2026 event in Miami: each worker has a defined role and goal, uses only governed customer context and approved tools, and runs on demand, on a schedule or proactively. Treasure AI showed a worker building a multi-stage customer journey with ready-to-send emails, which places Digital Worker inside customer journey orchestration (CJO), and gave no general availability date or pricing. MediaClaw, which calls itself the Agentic PR Operating System, debuted AI agents that research, pitch, follow up and report on media coverage, with a compliance mode that flags SEC, FDA and FTC issues and plans from $1,000 to $5,000 or more per month, in invitation-only private beta. Treasure AI and MediaClaw both keep a human in the loop (HITL) at the decision point, which matches the hybrid model Smith.ai measured at a 52% booking rate.

Cheaper inquiries move the work downstream. Reshift Media, a franchise marketing agency, reported in its Q3 2026 Franchise Development Outlook that franchise social ad engagement rose 26.8% year over year, click-to-inquiry conversion rose 166.6% and cost per inquiry fell 68.0%, while its franchise demand index fell 40.7% from its February 2026 peak. Reshift Media noted that the ad gains do not necessarily mean more qualified candidates. Every additional inquiry lands on an intake process, and Smith.ai found that two in three qualified legal leads hang up without a defined next step.

Agency rosters are consolidating as well. MMGY Global, the travel, tourism and hospitality marketing firm, announced on October 16, 2026 that R&R partners, the independent agency based in Las Vegas, has joined MMGY Global, for a combined staff of more than 800 people. Brands that already work with both agencies, including the LVCVA, Brand USA, Discover Puerto Rico and Explore St. Louis, now have one parent company on both sides of the table.

The October 16, 2026 releases leave CMOs three decisions: which customer conversations an agent handles alone, what the brand discloses when AI produces an ad, and whether customer data is clean enough for the several AI tools your team already runs against it.

Price the AI-only booking gap before you automate intake

Take a multi-location home services brand that receives 2,000 qualified inbound leads a month. Apply Smith.ai’s October 16, 2026 booking rates: human-only handling books 1,180 of them, hybrid handling books 1,040, and AI-only handling books 660. Assume each booked job carries $150 of margin. Moving from human-only to AI-only gives up 520 bookings, or $78,000 of margin a month. Moving from human-only to hybrid gives up 140 bookings, or $21,000.

Now the cost side. Assume live-agent coverage for that volume costs $24,000 a month. Smith.ai reported that hybrid service costs more than 50% less than live-agent-only service, so hybrid saves at least $12,000. At $150 of margin per booking, you spend $12,000 to save $21,000 worth of bookings, and human-only handling wins. The hybrid model pays when a booking carries roughly $86 of margin or less. Run the same arithmetic with your own margin, volume and agent cost before a vendor runs it for you.

Then look at the larger number. Smith.ai reported that firms with instant scheduling converted 64% of qualified leads and firms without it converted 12%, falling to 7% after hours, when about one in five calls arrive. That 52-point gap is twice the 26-point gap between human-only and AI-only booking. I’ve watched teams spend a quarter tuning a chatbot script while the booking link still sent customers to a contact form. Fix the scheduling step first, then decide who answers the phone.

Smith.ai measured law firm calls. Your category, ticket size and caller intent will shift every rate above, so treat the arithmetic as the method and your own call data as the inputs.

Treat these figures as vendor claims until your data confirms them

Smith.ai drew its rates from its own call data across law firm clients. Huble surveyed conference attendees, reported unweighted results, and stated that its sample does not represent all HubSpot customers. Auros commissioned its consumer study, and Talker Research fielded it. Treasure AI’s customer results come from its own award program, and Digital Worker has no published availability date or price. MediaClaw is in private beta with no named customers. Reshift Media built its demand and engagement figures on proprietary, unaudited indices and cited a September 2026 study of franchise prospects without a sample size. Kling AI issued two releases on October 16, 2026 that disagree on whether 4K HDR and 21:9 output are available now, and its user counts are self-reported. Treat every number in this edition as a vendor claim until your own data confirms it.

Set these priorities before you add another agent

Strategic priorities for marketing leaders:

  • Measure booking rate by handling type. Split your own qualified leads by human, hybrid and AI-only handling before you expand any agent, and compare against Smith.ai’s 59%, 52% and 33%.
  • Fix scheduling before staffing. Smith.ai’s gap between firms with and without instant scheduling exceeds its gap between human and AI handling.
  • Write an AI disclosure rule for creative. Auros found 44% of U.S. adults avoid brands that use AI in ads, and only 20% can identify AI-enhanced products, so decide what your brand discloses before production volume grows.
  • Audit the customer record your tools share. Huble’s respondents run Claude, ChatGPT and Copilot alongside HubSpot agents; every tool reads the same CRM, duplicates included.
  • Ask agent vendors for a role definition and an approval point. Treasure AI and MediaClaw both describe agents with defined jobs and human sign-off; require the same in every contract.
  • Track cost per qualified lead, and stop reporting cost per inquiry alone. Reshift Media’s 68% drop in cost per inquiry came with a 40.7% fall in its demand index.

So which step should the agent take? On October 16, 2026, Smith.ai put the highest booking rate with people, and Treasure AI and MediaClaw kept a person at the approval step. Before you expand any agent, pull your booking rate by handling type, write down your AI disclosure rule, and fix the scheduling link every agent will send customers to.
